We have some helpful information for anyone whose business has a pending civil summons issued by a city agency.

When a city agency such as the Health Department, Department of Consumer Affairs, FDNY, Sanitation, DEP, etc., issues your business a civil summons, the summons is adjudicated by the New York City Office of Administrative Trials and Hearings (OATH), the City's independent administrative tribunal.

OATH has announced some policies designed to help small businesses:
  • If you request to reschedule the court date on your summons, OATH will accommodate your request
  • If you miss the court date on your summons, it will be automatically rescheduled
  • If you'd like to go forward with your hearing, you can request that it be done by phone
OATH also has a help center for each borough, designed to help people understand the process if you've been issued a summons.  Contact information for each help center, along with more information about OATH's COVID policies, can be found on the attachment.
